Chapter 2: The Secret Recording

The sound coming from Emily’s phone was quiet at first.

A woman’s voice.

Angry.

Sharp.

Then the courtroom speakers picked it up clearly.

“Stop crying, Emily. You’re making this harder than it needs to be.””

I felt every muscle in my body tighten.

Sarah’s face changed instantly.

“Turn that off,” she said.

The judge raised a hand.

“Mrs. Carter, you will remain silent.””

Sarah looked around the courtroom as if searching for someone to rescue her.

But nobody moved.

Not even her attorney.

The recording continued.

A younger version of Emily’s voice whispered:

“I don’t want to say bad things about Daddy.””

Then Sarah answered.

“Then you need to understand what happens if you choose him.””

My stomach dropped.

Emily covered her mouth.

She had heard these words before.

I had not.

The judge leaned forward.

“Continue playing.””

My attorney looked at me.

I could barely breathe.

For months, I had wondered why Emily became nervous before custody exchanges. Why she apologized constantly. Why she would say things like, “I’m sorry if Mommy gets upset.””

Now I knew.

The recording played again.

Sarah’s voice filled the courtroom.

“Your father thinks he can take you away from me.””

Emily responded quietly.

“He doesn’t want to take me away. He just wants me to be okay.””

There was a pause.

Then Sarah said:

“You don’t understand adult things.””

The recording stopped.

Emily’s thumb hovered over the screen.

The judge looked at her.

“Is there more?””

Emily nodded.

“Yes.””

Sarah suddenly spoke.

“Your Honor, this is ridiculous. She’s eight years old. She doesn’t understand what she’s doing.””

The judge looked directly at her.

“Mrs. Carter, an eight-year-old child does not usually bring evidence into a courtroom unless she believes something important needs to be heard.””

Sarah’s jaw tightened.

“She’s been coached.””

My attorney stood.

“Your Honor, my client has repeatedly encouraged Emily to maintain a healthy relationship with her mother. We have never asked this child to choose sides.””

Sarah laughed bitterly.

“Of course you haven’t. You just made sure she hated me.””

Emily looked at her mother.

That hurt me more than any accusation Sarah had made against me.

Because Emily didn’t look angry.

She looked heartbroken.

“Mommy,” she whispered.

Sarah looked at her.

“What?””

Emily held the phone tighter.

“Why did you tell me Daddy would leave me if I told the truth?””

The entire room went quiet.

Sarah’s expression changed.

Just for a moment.

Fear replaced anger.

The judge noticed.

“What is she referring to?””

Sarah looked away.

“I don’t remember saying that.””

Emily’s eyes filled with tears again.

“You did.””

The judge motioned toward the phone.

“Play the next recording.””

Emily pressed the screen.

This time, the recording was from a few weeks earlier.

I recognized the background immediately.

My old house.

The kitchen.

The place where Emily and I used to make pancakes every Sunday morning.

But Sarah’s voice was there.

Not mine.

“Emily, when the judge asks questions, you need to remember who takes care of you every day.””

Emily’s voice sounded scared.

“But Daddy takes care of me too.””

Sarah replied:

“Your father wants you to say that. He’s trying to make you forget who your real family is.””

I closed my eyes.

A memory flashed through my mind.

Emily sitting on my shoulders at the park.

Emily falling asleep on my couch during movie nights.

Emily running through the front door yelling, “Daddy, I’m home!””

And somehow Sarah had convinced her that loving me meant betraying her.

The recording ended.

Nobody spoke.

Then Sarah’s attorney quietly leaned toward her.

“Sarah, is there anything else you need to tell me?””

She didn’t answer.

The judge looked at Emily.

“Where did you get this phone?””

Emily looked down.

“I hid it.””

Sarah gasped.

“You stole from me?””

Emily immediately shrank back.

“No.””

The court officer stepped closer.

“It’s okay. Tell the truth.””

Emily took a shaky breath.

“Mommy gave me the phone last year because she wanted me to call her if Daddy said anything bad about her.””

I frowned.

“That’s not true.””

Emily looked at me.

“I know.””

The judge looked confused.

“Then why did you keep it?””

Emily stared at the phone.

“Because after a while…”

She paused.

Her voice became almost silent.

“I realized Mommy was recording me too.””

Sarah’s face went completely white.

The judge leaned forward.

“Recording you saying what?””

Emily looked at the phone screen.

May you like

Then she whispered:

“Things she wanted Daddy to get blamed for.””
