Chapter 10: The Condition That Could Cost Me Everything
I didn't sleep that night.
Eleanor's words kept repeating in my head.
If you ever knowingly allowed someone to take Ethan's home away from him, your rights under the trust would change.
At six in the morning, I called Robert.
He answered sounding exhausted.
"Michael, what's happened?""
I explained Daniel's visit and showed him the photograph.
When I mentioned the second beneficiary, Robert became very quiet.
"Bring the original trust documents to my office. And bring Eleanor.""
By nine, we were sitting around his conference table.
Eleanor had brought another folder.
Robert placed the original trust agreement in front of him and began reading carefully.
"Here it is," he said.
He turned the document toward me.
There was a section titled Protective Beneficiary Provision.
I read it twice.
Laura had created two protected interests.
The first belonged to Ethan.
The second belonged to me.
However, my interest was conditional.
If I knowingly participated in an unauthorized transfer that endangered Ethan's right to occupy the property, my beneficial interest would be suspended.
I looked at Robert.
"Why would Laura put that condition in there?""
He adjusted his glasses.
"Because she wanted to make sure you never allowed someone to pressure you into sacrificing Ethan's future.""
Eleanor nodded.
"Laura knew you loved Daniel. She was afraid you would give him another chance at Ethan's expense.""
I rubbed my forehead.
"She thought I would do that?""
"She hoped you wouldn't," Eleanor replied.
"But she knew you.""
Robert continued reading.
"There's another important provision. If the primary beneficiary's rights are threatened through fraudulent conduct, the successor trustee has authority to seek immediate protective relief.""
"So Eleanor can protect the property?""
"Subject to the trust's terms and applicable law, yes.""
I looked at Eleanor.
"Why didn't you tell me about this earlier?""
She reached across the table.
"Because Laura asked me not to discuss the details unless there was a genuine threat. She didn't want you worrying about a problem that might never happen.""
I looked away.
Laura had known my weaknesses better than anyone.
And Daniel had spent years exploiting them.
Robert placed the photograph on the table.
"There's something else we need to understand. Daniel wanted your signature because he knew the trust provisions could complicate any attempt to use the property as collateral.""
"Could signing his authorization have cost me my interest?""
"Potentially. We'd need to analyze the exact language and circumstances, but the document was clearly designed to create evidence that you knowingly approved the transaction.""
I felt sick.
One signature.
That was all Daniel needed to turn me from a father protecting his son into a man apparently consenting to the destruction of his son's rights.
Robert closed the folder.
"We should notify the trustee, the lender, and the appropriate authorities about the suspected fraud. We also need to preserve the original documents and secure your financial accounts.""
Eleanor nodded.
"Do whatever is necessary.""
Then my phone rang.
Daniel.
I answered and put it on speaker.
"What do you want?""
"Good morning, brother.""
His voice sounded almost cheerful.
"Have you read the documents?""
"Yes.""
"And?""
"And I'm not signing anything.""
He sighed.
"Michael, I really hoped you'd be reasonable.""
"You forged my signature.""
"That's your interpretation.""
"Patricia admitted she never witnessed me sign.""
A pause.
"Patricia talks too much.""
Robert immediately wrote that down.
Daniel continued.
"Listen. Richard has arranged everything. If you cooperate, you'll receive enough money to pay off any remaining family expenses.
Madison gets a fresh start. Vanessa gets her security. Everyone benefits.""
"What about Ethan?""
"He's eighteen. He can build his own life.""
"He already is.""
Daniel laughed.
"You're letting a boy destroy a serious business opportunity.""
I felt my face grow hot.
"He's my son.""
"And I'm your brother!""
I leaned closer to the phone.
"Then you should have remembered that before trying to steal his home.""
Daniel's voice became cold.
"You're going to regret this.""
He hung up.
Robert looked at me.
"Don't contact him again without speaking to me first.""
I nodded.
But Eleanor was staring at her phone.
"What is it?"" I asked.
She showed me a message.
It was from an unknown number.
Mrs. Bennett, you need to know that Daniel has already arranged a meeting with the trust's previous financial administrator. He intends to challenge the original documents.
Eleanor looked at Robert.
"Who is the previous administrator?""
Robert checked the trust records.
Then he stopped.
"That's interesting.""
"What?""
He turned the laptop around.
The previous financial administrator was a man named Thomas Reed.
And according to the records, Thomas had died two years earlier.
But someone had recently submitted a document bearing his electronic authorization.
The date was yesterday.
Robert slowly closed the laptop.
"Someone is impersonating a deceased administrator.""
I looked at Eleanor.
She looked back at me.
Then she whispered something I would never forget.
May you like
"Michael, Thomas was the only person besides Laura who knew where the original beneficiary instructions were hidden.""
And Daniel had apparently found someone willing to pretend Thomas was still alive.
