Chapter 11: My Son Tried to Have Me Declared Incapable

The document carried the heading:

*PETITION FOR EMERGENCY GUARDIANSHIP AND CONSERVATORSHIP.*

I read the first paragraph.

Then the second.

According to the petition, I had been experiencing memory loss, emotional instability, confusion, and increasingly irrational behavior.

It even mentioned the incident with Tiffany's Gucci handbag.

Daniel had described it as evidence of "violent and unpredictable behavior.""

I stared at the screen.

"He wants a judge to believe I'm incapable of making decisions?""

Thomas nodded.

"That's what the petition suggests.""

"But I'm not incapable.""

"I know. And we have documentation supporting your independence.""

Eleanor opened her briefcase.

"Robert also anticipated this possibility.""

She removed another folder.

Inside were copies of financial evaluations, legal authorizations, and a letter from Robert's physician.

I looked confused.

"Why would Robert have these?""

Eleanor explained that Robert had arranged for me to undergo an independent cognitive and financial capacity assessment during our estate-planning process.

Not because he believed anything was wrong with me.

But because he wanted an objective record proving I understood my finances and could manage my affairs independently.

The assessment had been completed by an independent specialist.

It showed that I was fully capable of managing my property and financial decisions.

Thomas examined the documents.

"This is excellent evidence. We'll submit it with our response.""

I felt a lump in my throat.

Robert had somehow prepared for every possibility.

But the thought that my own son had tried to label me incompetent was almost unbearable.

I stood and walked toward the window.

"Daniel knows me. He knows how I think. He knows I remember everything.""

Thomas spoke gently.

"People sometimes convince themselves that their actions are justified.""

I turned around.

"Is that what we're supposed to call stealing now? A misunderstanding?""

Nobody answered.

My phone rang.

Daniel.

I stared at his name.

Then I answered.

"Hello.""

"Mom, I heard you're making trouble with the trust.""

I almost laughed.

"You're the one who filed a petition claiming I can't manage my own life.""

"Because you're acting irrationally!""

"Daniel, I have been managing my finances for forty years.""

"You threw Tiffany's handbag into a fire!""

"After she destroyed my birthday cake in front of thirty people.""

"That's exactly what I'm talking about!""

I lowered my voice.

"Daniel, did you really tell a court that I was mentally incapable?""

He sighed.

"Mom, it's temporary. We just need someone to manage things until you're settled.""

"Someone like you?""

"Yes. I know the family finances.""

I looked at Thomas.

He silently motioned for me to continue.

"Then explain why you transferred $84,500 to Tiffany.""

"That money was being moved for safekeeping.""

"Why did you submit a false power of attorney?""

"I didn't forge anything.""

"Why did you try to sell my house?""

He raised his voice.

"Because you weren't using it properly!""

I closed my eyes.

There it was.

Not an apology.

Not regret.

Entitlement.

"Daniel, your father knew you might do this.""

Silence.

"What?""

"Robert left instructions. He protected the house, the investments, and Lily's inheritance.""

Daniel's breathing changed.

"Mom, what did you just say?""

I repeated myself.

"Your father created a trust. If you attempted to take my property, the inheritance would go to Lily.""

He started shouting.

"That's impossible!""

"Your father made that decision.""

"He wouldn't do that to me!""

I looked at the photograph of Robert on my desk.

"He wouldn't have done it if you hadn't given him a reason.""

Daniel's voice became desperate.

"Mom, listen. We can fix this. Just withdraw the complaint.""

"No.""

"You're destroying my life!""

I felt tears gathering.

"No, Daniel. I'm finally refusing to let you destroy mine.""

I ended the call.

Thomas immediately contacted the court clerk to confirm the petition's status.

It had been submitted, but no emergency order had been granted.

We prepared an objection and attached my independent assessment, the trust documents, and the evidence of the fraudulent transactions.

Then Eleanor made another call.

She wanted the trust's independent auditor to review every transaction connected to Daniel and Rebecca.

An hour later, the auditor returned her call.

He had found something.

A large payment had been made from the business loan account to an investment company in Florida.

The recipient's name was unfamiliar.

But the address was familiar.

It was the same address listed on Rebecca Sloan's notary registration records.

Thomas immediately asked for the transaction details.

The payment was $92,000.

I sat down.

"How much money has this woman taken?""

Eleanor looked at the spreadsheet.

"Potentially much more than we initially believed.""

Then Thomas opened a document that had arrived from the bank.

It was an account access history.

Someone had attempted to log into my savings account three times that morning.

The login location was traced to a computer inside a hotel.

Daniel's hotel.

I looked at the timestamps.

The most recent attempt had happened only eleven minutes earlier.

Thomas contacted the bank's security team and requested that all digital access be suspended until the investigation was complete.

Then Eleanor noticed something in the account records.

"Margaret, look at this.""

She pointed to a scheduled payment.

A recurring transfer of $7,500 had been set up from my account to a private financial company.

The first payment was due the following Monday.

The authorization date was six weeks earlier.

I stared.

"That's not mine.""

Thomas zoomed in on the attached authorization.

The document contained my signature.

But beneath it was a second signature.

Daniel's.

And beside his signature was a handwritten note.

*Payment authorization valid until account holder is permanently relocated.*

I felt the room go silent.

Permanently relocated.

I looked at Thomas.

"Does that mean they planned to keep taking my money after moving me into assisted living?""

He nodded slowly.

"It appears that way.""

Eleanor picked up her phone.

"I'm contacting the trust's fraud investigators.""

Before she could dial, an incoming call appeared on my screen.

It was Tiffany.

I answered.

"Margaret?""

Her voice was trembling.

"Daniel found out about the inheritance.""

"I know.""

"No, you don't understand. He's furious. He says Lily can't receive the money.""

I tightened my grip.

"Where is Lily?""

"She's with my sister. She's safe.""

"Good.""

Tiffany lowered her voice.

"Margaret, there's something I haven't told you.""

"What?""

"Rebecca has another copy of the documents. And she's planning to leave the country tonight.""

My heart began racing.

"Why?""

"Because Daniel promised her a share of the inheritance. But now that he knows Lily is the beneficiary, he's blaming her for everything.""

I looked at Thomas.

He immediately began writing.

Then Tiffany whispered the words I would never forget.

"Margaret, Rebecca didn't just forge your signature.""

May you like

I held my breath.

"She forged Robert's signature too.""
