Chapter 2: What Emily Heard

Judge Harrison cleared the courtroom.

Everyone except the attorneys, Ms. Reynolds, the bailiff, Sarah, Emily, and me was ordered outside.

The heavy doors closed.

I could hear my own heartbeat.

Emily sat with the pink phone resting between her hands.

Sarah leaned toward Claire.

Their whispering became urgent.

I caught only fragments.

“...inadmissible…”

“...child recorded…”

“...don't consent…”

Judge Harrison looked toward them.

“Counsel?””

Claire stood.

“Your Honor, before anything is played, I object to the court reviewing a recording obtained under unknown circumstances by an eight-year-old child.””

Michael rose.

“Your Honor, given that the device was allegedly provided by Mrs. Carter specifically for secret communications during Mr. Carter's parenting time, I believe the circumstances themselves are relevant.””

“Allegedly,” Claire snapped.

Emily flinched.

Judge Harrison noticed.

“So did Ms. Reynolds.

“Counsel,” the judge said, “both of you sit down.””

They did.

He looked at Emily.

“Did your father tell you to record your mother?””

“No.””

“Did your father's lawyer?””

“No.””

“Ms. Reynolds?””

“No.””

“Did anyone tell you to bring this phone today?””

Emily shook her head.

“No.””

Sarah suddenly spoke.

“Then why did you?””

Emily looked at her.

Sarah's voice softened instantly.

“Sweetheart, why would you do something like this to Mommy?””

There it was.

Not anger.

Something worse.

Guilt.

Emily's face crumpled.

“Sarah,” I said.

Michael grabbed my sleeve.

Judge Harrison's eyes narrowed.

“Mrs. Carter, you will not question the child.””

“I was asking my daughter—”

“You were instructed not to.””

Sarah leaned back.

Emily wiped her cheek.

“I brought it because Mommy said nobody would believe me.””

The words landed harder than anything else she'd said.

Judge Harrison looked toward Ms. Reynolds.

“Would you take Emily into the conference room for a moment?””

Emily immediately looked at me.

“Dad?””

“I'm right here.””

“Promise?””

“I promise.””

She stood.

Then she ran three steps toward me before Ms. Reynolds could stop her.

I dropped to one knee.

Emily wrapped her arms around my neck.

“I'm sorry.””

Those two words nearly destroyed me.

I held her carefully.

“For what?””

“The phone.””

“You have nothing to apologize for.””

Sarah made a sound behind me.

A bitter little laugh.

“Unbelievable.””

Emily stiffened.

I felt it happen.

Her whole body locked against mine.

Judge Harrison saw that too.

“Ms. Reynolds.””

She guided Emily toward the conference room.

Before disappearing through the door, my daughter looked back at me.

Then at Sarah.

The fear returned.

The door closed.

Judge Harrison removed his glasses.

“Mrs. Carter, I want an explanation for the phone.””

Sarah's posture changed.

Without Emily present, the wounded-mother performance vanished.

“I bought our daughter a phone.””

“A phone you instructed her to conceal from her father?””

“I didn't trust Daniel.””

“Why?””

“Because he's manipulative.””

Michael whispered, “Don't react.””

I didn't.

Judge Harrison continued.

“Did you use that phone to question your daughter about events in Mr. Carter's home?””

“I checked on her.””

“Did you ask her whether Mr. Carter drank alcohol?””

Sarah hesitated.

“I may have.””

“Whether women visited?””

“I don't remember.””

“Whether he became angry?””

“I was concerned about my child's safety.””

Judge Harrison leaned back.

“Then why conceal the device?””

Sarah looked toward Claire.

Her attorney didn't rescue her.

“I knew Daniel would take it away.””

The judge stared at her for several seconds.

Then he turned to me.

“Mr. Carter, have you ever prevented your daughter from contacting her mother during your parenting time?””

“No, Your Honor.””

“Has she had access to your phone?””

“Always. Sarah's number is saved under Mom. Emily can call whenever she wants.””

Sarah scoffed.

“He listens.””

I turned toward her.

“No, Sarah. I don't.””

“Sure.””

Judge Harrison raised one hand.

“Enough.””

He ordered a short recess while the attorneys addressed the recording issue.

I walked into the hallway.

My legs felt strangely weak.

Michael followed.

“This changes things,” he said.

“What exactly changes?””

“The judge just watched Sarah intimidate Emily in open court.””

I looked through the narrow window in the courtroom door.

Sarah was arguing with Claire.

“What could possibly be on that recording?””

Michael didn't answer.

Then Ms. Reynolds appeared.

“Daniel?””

I turned.

“Emily wants you.””

I followed her into a small consultation room.

Emily sat at a round table with crayons scattered across it.

She was drawing a house.

Two stick figures stood outside.

One tall.

One small.

“Hey, peanut.””

She looked up.

“Is Mommy mad?””

My throat tightened.

“Mommy's feelings aren't your responsibility.””

She stared at her drawing.

“I wasn't supposed to hear them.””

“Hear who?””

“Mommy and Grandma.””

I sat across from her.

“Where?””

“Grandma's kitchen.””

Sarah's mother, Patricia, had always disliked me.

That wasn't new.

But Emily's next words were.

“They thought I was asleep.””

I waited.

Emily drew a black line beneath the house.

“Mommy said she needed you to mess up.””

“How?””

“She said if you didn't mess up by yourself…”

Emily stopped coloring.

“What, sweetheart?””

Her voice became almost inaudible.

“She'd make it look like you did.””

Cold spread through my chest.

“What did Grandma say?””

Emily looked toward the door.

“She told Mommy it was dangerous.””

My mouth went dry.

“And then?””

“Mommy said she already had everything she needed.””

Before I could ask what that meant, someone knocked.

Ms. Reynolds opened the door.

Michael stood outside.

His face told me something had happened.

“Daniel.””

I stood.

“What?””

He glanced at Emily, then lowered his voice.

“Sarah's attorney just asked to withdraw.””

I stared at him.

“In the middle of the hearing?””

“Yes.””

“Why?””

May you like

Michael looked toward the courtroom.

“Because Sarah finally told her what might be on that recording.””
